Clarification of Disputes

The primary avenues for resolving disputes include litigation, arbitration and alternative dispute resolution (e.g., arbitration and reconciliation). Disputes with administrative bodies can be resolved through administrative review and administrative court proceedings. Arbitration is recommended in court, review, and arbitration proceedings. 

The judicial system of the PRC consists of the Supreme People's Court of the People's Republic of China, local people's courts at different levels (including higher, middle and lower people's courts) and specialized people's courts (military courts, high seas courts, intellectual property courts, financial courts, etc.) 

The PRC has a well-established arbitration mechanism. Arbitrations in the PRC are conducted by arbitration committees located in municipalities, provincial capitals and other cities with subdistricts. The China International Economic and Trade Arbitration Commission (CIETAC) and the China Maritime Arbitration Commission (CMAC) are two major permanent commercial arbitration bodies that are recognized both domestically and internationally for their independence, impartiality and efficiency.
