According to Chinese family law, spouses in China can opt for a judicial or extrajudicial divorce. If the spouses can reach a divorce settlement without dispute, including an amicable settlement of shared assets and custody issues, they can divorce without going to court. However, a court order for divorce or a court judgment makes subsequent recognition abroad easier, for example if you later want to have the legality of the divorce recognized in Germany or other similar countries.

If divorce proceedings are initiated in the Chinese court and legal advice is required, one must hire a Chinese lawyer instead of a foreign lawyer.
